These Terms and Conditions ("Agreement") govern your use of the GiftCardium platform (hereinafter referred to as the "Platform"), operated by NUARTES TRANSFERS S.L. (hereinafter referred to as the "Company," "us," or "our"), a limited liability company established on 12/04/2024, with its registered address at Paseo Sant Joan, 6 - PTA 1, 08010, Barcelona, Spain and registration number B70869250.

1. Definitions

  • Gift Card: Refers exclusively to the branded and merchant-specific prepaid cards available for purchase directly from the Platform.
  • Website: Refers to the online platform located at www.giftcardium.com, which facilitates the browsing, selection, and purchase of a range of branded gift cards.
  • Customer: Refers to any individual or entity purchasing gift cards through the Platform, subject to the terms of this Agreement.
  • Merchant: Refers to the third-party businesses or brands that issue and honor the specific gift cards sold on the Platform.

2. Scope of Services

2.1. Direct Gift Card Sales

The Platform specializes in offering a curated selection of branded and merchant-specific gift cards for customers to purchase. Each gift card is tailored for use with its designated merchant or service provider and is sold as a standalone product.

2.2. Exclusions

Each card available on the Platform is tied directly to a specific brand or merchant and may not be exchanged for other cards or cash.

2.3. Platform Transparency

All products available for purchase are clearly described on the Platform, including the terms and conditions applicable to their use as determined by the respective merchants.

3. Using the Platform

3.1. Purchasing Process

  • Visit www.giftcardium.com and browse the available options.
  • Select the desired branded or merchant-specific gift card.
  • Complete your purchase by following the on-screen instructions and selecting a valid payment method.

3.2. Delivery Options

Upon successful payment, gift cards are delivered to the customer's registered email address within the timeframe specified during the purchase process.

3.3. Restrictions on Use

  • Gift cards sold on the Platform cannot be used to purchase additional gift cards or other financial products.
  • Gift cards are non-transferable and cannot be exchanged for cash or other merchandise unless explicitly allowed by the issuing merchant's policies.

3.4. Account Management

Customers are responsible for maintaining the security of their Platform accounts. Unauthorized access due to negligence is not the responsibility of the Company.

4. Returns and Refunds

4.1. Refund Eligibility

Refunds are only available under the following conditions:

  • The purchased gift card was not delivered due to an error attributable to the Platform.
  • The gift card was invalid or non-functional upon delivery, provided the issue is reported within 14 days of purchase.

4.2. Exclusions

  • Refunds will not be granted for customer errors, such as purchasing the wrong card or providing incorrect recipient details.
  • Gift cards are non-refundable once they have been successfully delivered and activated.

4.3. Dispute Resolution

If a dispute arises regarding the functionality or validity of a gift card, customers are encouraged to contact our support team. The Platform may act as a mediator with the issuing merchant to resolve the issue but does not guarantee outcomes beyond its control.

5. Prohibited Activities

Customers agree not to engage in the following prohibited activities:

  • Use any gift card purchased on the Platform to acquire additional gift cards or financial products.
  • Attempt to resell, alter, or misuse gift cards in a manner inconsistent with their intended purpose.
  • Use the Platform for fraudulent or unlawful activities, including money laundering or financial fraud.

The Company reserves the right to suspend or terminate accounts found to be in violation of these terms.

6. General Terms

6.1. Merchant-Specific Terms

Each gift card sold on the Platform is subject to the terms and conditions established by the issuing merchant or brand. Customers are encouraged to review these terms before making a purchase.

6.2. Limitation of Liability

The Company is not liable for the terms, policies, or actions of the merchants issuing the gift cards sold on the Platform. Customers agree to indemnify the Company against claims arising from the misuse of gift cards.

6.3. Governing Law

This Agreement is governed by the laws of Spain. Any disputes shall be resolved in the competent courts of Barcelona, Spain.
